The Landlord & Tenant Board is a decision-making body created by the Residential Tenancies Act of Ontario (RTA). The Board has exclusive jurisdiction over virtually all disputes related to a tenancy and does not have jurisdiction to deal with issues where the tenant has moved out of the premises. If the Tenant

• Has not paid rent
• Has been persistently late with rent
• Willfully and negligently damaged the property
• Interfered with the enjoyment of others
• Has too many people living in the unit
• Used the unit in a manner inconsistent with its intention and caused damage
• Committed an illegal act (with or without an illegal drug)
• Received notice that the landlord intends to renovate or move in a relative
• Gave notice that they were intending to move out
• Received notice of a rent increase and refuses to pay
• No longer qualifies for public or subsidized housing

If the Landlord:

• Gave tenant a termination notice
• Because their relative is moving in
• Because landlord was going to demolish, renovate, or repair
• Did not maintain or repair the property
• Charged illegal rent
• Made an illegal charge
• Entered the unit without notice
• Did not use your rent deposit properly
• Interfered with reasonable enjoyment of the unit
• Harassed, coerced, or threatened the tenant
• Changed the locks without the tenants permission
• Withheld or interfered with vital services (utilities)
• Reduced or discontinued a service
• Did not reduce rent in accordance with lower municipal taxes

Small claims court is a division of the Superior Court of Justice in Ontario that provides individuals and companies a venue to address their legal issues and concerns in front of a Judge in disputes not exceeding $25,000. In these circumstances the party that commences the action is called the Plaintiff and the party who defends the action is called the Defendant.
